Description

Practitioners before the EEOC are familiar with the remedies commonly awarded to successful complainants, such as compensatory damages and attorneys' fees. However, there are more complex remedies available that savvy practitioners need to understand for purposes of preparing and conducting discovery and valuing potential liability of a case. This session will focus on those more complex issues, including when an agency must bump an incumbent of a position to place the complainant in a non-selection case, how to show an employee has not sufficiently mitigated a claim for back pay, and deciphering and responding to complex petitions for legal fees and costs, including where the complainant has retained counsel from outside the area for representation.
